What are some crucial things to remember before applying for an H1B and L1 visa?
Rajiv mentioned that while this was not a topic he could cover in just a few minutes, he did happen to share some of the best practices that will help the attendees. While a degree in economics will help you grant the H1B visa status, a BA degree will not qualify for the same. At least 40% of people in the US are from India and have an H1B or L1 visa. Therefore, before applying for an H1B, or L1 visa, it is crucial that you know if you are eligible or not.
If a person has worked for an IT company for three years or more, they will be qualified for an H1B or L1 visa because of their experience. To be eligible for an H1B or L1 visa, a person has to have a job offer from an American company and then would see if they get selected via lottery. Once it is conducted, you have a 50-50 chance.
What happens when your H1B visa is denied?
Once your H1B visa application is denied, there are two obvious choices: An MTR appeal and a lawsuit. Very few H1B applications are denied, but you go with the choice that works best for you as soon as it is denied.
An MTR appeal is a challenge made either through filing a motion to reopen or reconsider (motion, or MTR) with the USCIS or an appeal to the Administrative Appeals Office (AAO).
- Is a client letter necessary for an H1B Visa?
No, not necessarily. In case a letter is asked, it should be on company letterhead with the signature of issuing and the concerned person of the client company. The client should provide this letter if the H1B job is to work for a client project.
Is the L1 visa a grey area if I don’t have a single direct reporting manager?
Yes, to begin with, it is a grey area where you have to prove that there is a separate function in the organization, which is essential. You have plenty of functional advantages as long as you can prove this.
Are H4 visa applications accepted at dropbox?
The best response for this query can come from the support team at the dropbox location. They will be able to guide you through what you need. Alternatively, you can drop an email to the consulate detailing your query.
How to get an update from the consulate if they are not responding to emails regarding visa stamping?
For many reasons, it is pretty difficult to win a lawsuit again 221G. You can apply for the right to determine and examine each visa to understand what went wrong.
